Terms of service
1. Two kinds of users
- Venues (“clubs”) subscribe to our services to run their business. A separate subscription agreement or order may add to these terms; if the two conflict, it wins.
- Players and customers use the services to book, pay, join memberships and play in leagues at a club. The club is the business you’re dealing with: its prices, policies (including cancellation, refunds and waivers) and conduct are its own, and your contract for a booking or membership is with the club, not with IGM.
2. Your account
You need to be at least 13 to create an account, and old enough in your area to agree to these terms. Keep your sign-in details private: you’re responsible for what happens under your account. Tell us promptly if you think someone else has used it. One IGM account works across our products.
3. Payments
- Players and customers: card payments to a club are processed by Stripe on the club’s behalf, and the club is the seller. Refunds follow the club’s policy.
- Clubs: clubs pay subscription fees, and any platform fees shown in their plan, as agreed. Stripe’s processing fees apply to card payments. Fees are non-refundable unless the law or your agreement says otherwise. We may change prices with at least 30 days’ notice.
4. Acceptable use
Don’t:
- break the law, or use the services to harm others;
- try to get into accounts, data or systems you’re not allowed to access;
- interfere with the services or overload them;
- copy, resell or reverse-engineer the services, except where the law allows it;
- send spam, or upload anything illegal, harmful or that infringes someone else’s rights.
We may suspend or close accounts that break these rules.
5. Content and data
You keep ownership of the content and data you or your club put into the services. You give us permission to host and process it to provide the services. Clubs are responsible for having the right to the customer information they upload, and for their own notices and consents to their customers.
Clubs can export their data, and we delete it within a reasonable time after a subscription ends, except where we need to keep it by law.
6. Our services
We work to keep the services available and secure, and we improve them over time; features may change. We don’t guarantee they will be uninterrupted or error-free. Our in-app help assistants can make mistakes, so check anything important.
7. Disclaimers
To the extent the law allows, the services are provided “as is”, without warranties of any kind, express or implied. That includes warranties of merchantability, fitness for a particular purpose and non-infringement.
8. Limitation of liability
To the extent the law allows, IGM isn’t liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data.
Our total liability for any claim is limited to the greater of: the amount you paid IGM in the 12 months before the claim, or US $100.
Nothing in these terms limits liability that can’t be limited by law.
9. Ending your use
You can stop using the services, or close your account, at any time. We may suspend or end access if you break these terms, or if we stop offering a service; in that case, we’ll give clubs reasonable notice where we can. Sections that by their nature should survive, such as liability limits, continue after access ends.
10. Governing law
These terms are governed by the laws of the State of California, USA, and disputes will be resolved in the courts located there, unless the law where you live requires otherwise.
11. Changes to these terms
We may update these terms. We’ll change the date above, and for significant changes we’ll tell you in the services or by email. Using the services after a change means you accept the new terms.
12. SimBook SMS terms
See our SMS program page for opt-in instructions and program details.
Program: SimBook by Indoor Golf Management. Where SMS is enabled, you can separately choose to receive automated transactional text messages from Indoor Golf Management about your SimBook bookings, waitlist requests and memberships at participating clubs. These include booking confirmations, reminders and changes, waitlist availability updates, and membership account notifications. Messages identify the relevant venue. This consent does not authorize promotional texts from a club or consent to any other SMS program.
Consent is optional and is not a condition of booking, purchasing or using SimBook. You can leave the SMS checkbox unchecked. Providing a phone number or agreeing to these general terms does not enroll you. Message frequency varies with your bookings, waitlist requests and membership activity. Message and data rates may apply; check your mobile plan for details.
Reply STOP to unsubscribe. We may send one confirmation of your opt-out, then stop messages from that SMS program. If you previously opted in, reply START to the sending number to resume texts after STOP, or opt in again through the SimBook consent form. START does not enroll imported contacts or anyone without a recorded affirmative opt-in. Reply HELP for assistance, or email hello@indoorgolfmanagement.com. For changes to your booking or a venue’s policies, contact that venue directly.
Carriers are not liable for delayed or undelivered messages. SMS delivery is not guaranteed. Please keep your contact details current and check your booking confirmation for time-sensitive information. How we protect your mobile number and consent records is explained in our privacy policy.
